Terms of Service

These terms govern your use of the AURAMED CHEMIST storefront and form a binding agreement between you and us.

1. Acceptance

By creating an account or placing an order, you agree to these terms and to our Privacy Policy, Shipping Policy and Returns & Refunds.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. Some products require a valid prescription and verification by our pharmacist before they can be dispensed.

3. Account

You are responsible for keeping your account credentials confidential. Notify us immediately if you suspect unauthorised access.

4. Products and pricing

All listed products are subject to availability.
Prices are displayed in Kenya Shillings (KES) and include applicable VAT unless otherwise stated.
We reserve the right to correct pricing errors and to change prices, withdraw products, or refuse orders at our discretion.
Product images and descriptions are for illustration. Always read the manufacturer-supplied labelling.

5. Prescription-required products

Prescription products may only be dispensed against a valid Kenyan prescription.
Our pharmacist verifies every prescription before dispensing. We may contact you for clarification.
If we cannot verify your prescription, we will cancel the relevant items, refund the corresponding amount, and ship the rest of your order.
Controlled drugs are dispensed under the additional Pharmacy and Poisons Board rules that apply to them.

6. Order acceptance

An order is an offer to buy. We accept the offer when we ship the products. We may refuse or cancel orders for any reason, including suspected fraud, abuse, regulatory concerns, or product unavailability. We will refund any payment for cancelled items.

7. Payment

We accept M-Pesa via Safaricom Daraja, and where available, cash on delivery.
For M-Pesa, you authorise the STK push at checkout. Funds are captured at order confirmation.
For cash on delivery, the full amount is due on delivery.
VAT-inclusive prices are shown at checkout.

10. Disclaimers

The product information shown on this storefront is provided for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always read the manufacturer-supplied label and patient information leaflet. If you have a medical question, speak to a pharmacist or doctor.

11. Limitation of liability

To the maximum extent permitted by law, our liability to you for any loss arising from your use of this storefront is limited to the amount you paid for the order in question. We are not liable for indirect, consequential, or incidental losses.

Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act, 2012 or the Sale of Goods Act.

12. Intellectual property

The storefront, its design, text, logos and code are owned by AURAMED CHEMIST or our licensors and may not be copied, reproduced, or used commercially without permission.

13. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these terms, abuse the service, or for legal reasons. Order history we are required to retain (for tax and PPB compliance) will be kept per our Privacy Policy.

14. Governing law and disputes

These terms are governed by the laws of Kenya. Any dispute will be subject to the exclusive jurisdiction of the courts of Kenya. Before going to court, we both agree to attempt resolution through good-faith discussion, and if that fails, mediation.

15. Changes

We may update these terms. Material changes will be notified to account holders by email at least 14 days before they take effect. Continued use of the storefront after that date constitutes acceptance.
